Acceptance of Terms

By accessing or using the website at siouxfallsconcretecontractor.com (the "Site"), or by engaging Elite Sioux Falls Concrete ("we," "us," or "our") for any concrete contracting services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or engage our services. We reserve the right to update these terms at any time. Continued use of the Site or our services after any change constitutes your acceptance of the updated terms.

Description of Services

Elite Sioux Falls Concrete provides residential and commercial concrete contracting services in Sioux Falls, SD and surrounding areas. Services include but are not limited to concrete driveway installation, patio construction, stamped concrete, sidewalk building, foundation work, flatwork, and related concrete services.

All services are subject to a written contract or work order agreed upon by both parties before work begins. The Site itself is informational only and does not constitute a binding service agreement. No work will begin until a written scope of work, price, and project timeline have been confirmed in writing.

Estimates and Pricing

Estimates provided verbally or through this Site are preliminary only. A binding price is established only in a signed written agreement or work order. Prices are subject to change if the scope of work changes, if unforeseen site conditions are discovered, or if material costs change significantly between estimate and project start.

We will notify you of any material changes to the original price before performing additional work or incurring additional costs. Written approval is required for any change orders that affect the total contract price.

Scheduling and Cancellation

Project start dates are scheduled based on crew availability, weather conditions, and material lead times. We will communicate your scheduled start date in writing at the time of contract signing. Start dates may be adjusted due to weather, material delays, or other conditions outside our control. We will notify you as promptly as possible of any scheduling changes.

If you cancel a scheduled project after a written agreement has been signed, any deposit paid may be non-refundable depending on the terms specified in your contract. Cancellation terms will be stated explicitly in your project agreement.

Payment Terms

Payment terms are established in your written project agreement. A deposit may be required before work begins. Final payment is due upon project completion and your walkthrough inspection, unless otherwise specified in your contract. Accepted payment methods will be listed in your agreement.

Invoices not paid by the due date specified in the agreement may be subject to a late fee as stated in your contract. We reserve the right to suspend work on any project where payment obligations are not met according to the agreed schedule.

Permits and Compliance

Where required by local ordinance, Elite Sioux Falls Concrete will obtain the necessary permits for the agreed scope of work. Permit fees, where applicable, may be included in the project price or billed separately as specified in your contract. You are responsible for ensuring that your property complies with any homeowners association rules or deed restrictions that may affect the project. We are not responsible for HOA violations that result from your failure to disclose applicable restrictions prior to work starting.

Warranty Disclaimers

We stand behind our workmanship. Any workmanship warranty provided will be stated in your written project agreement. Concrete is a natural material and minor surface variations, hairline cracks from normal curing, and color variation are inherent characteristics - not defects.

Warranty coverage does not extend to damage caused by: improper care or maintenance after project completion, use of de-icing salts or chemicals on concrete surfaces, ground movement or soil settlement beyond normal curing tolerances, acts of nature, vehicle damage, or modifications made by parties other than Elite Sioux Falls Concrete.

The Site and all information on it are provided "as is" without any warranty of any kind. We make no representations that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by law, Elite Sioux Falls Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, or the performance or non-performance of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from the services we perform shall not exceed the total amount you paid for the specific project giving rise to the claim. This limitation applies to the fullest extent permitted by applicable law.

Intellectual Property

All content on this Site - including text, images, logos, and design - is the property of Elite Sioux Falls Concrete or its content suppliers. You may not reproduce, distribute, modify, or republish any content from this Site without our prior written permission. Unauthorized use of our content may violate copyright, trademark, and other applicable laws.

Dispute Resolution

If a dispute arises between you and Elite Sioux Falls Concrete related to services performed, we ask that you contact us first and give us a reasonable opportunity to resolve the issue directly. If a dispute cannot be resolved informally, both parties agree to pursue resolution through binding arbitration or the appropriate courts in SD, before resorting to litigation. Nothing in this section prevents either party from seeking emergency injunctive relief where appropriate.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law principles. Any legal action or proceeding relating to these terms shall be brought exclusively in the state or federal courts located in Sioux Falls, SD.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to this Site with an updated effective date. It is your responsibility to review these terms periodically. Your continued use of the Site or engagement of our services after changes are posted constitutes your acceptance of those changes.
